Any order or booking implies unconditional acceptance of these General Terms and Conditions of Sale.
ARTICLE 1 – PURPOSE
These GTC define the rights and obligations of Cabaret L'Élégance and its clients in connection with the sale of tickets and services, including in particular:
- show-only performances;
- lunch-shows and dinner-shows;
- meals and beverages included in the various packages;
- special evenings and events;
- gift vouchers;
- and, more generally, any service offered for booking by Cabaret L'Élégance.
The essential characteristics of each service, including the date, time, chosen package and price, are provided to the client prior to order confirmation.
ARTICLE 2 – BOOKING AND ORDER CONFIRMATION
A booking becomes final upon order confirmation and receipt of the corresponding payment, unless specific conditions have been expressly agreed upon with Cabaret L'Élégance.
The client is required to verify, before confirming their order, the performance date, the number of guests, the chosen package and all information provided.
The booking confirmation and/or ticket sent to the client summarises the main details of the order.
Cabaret L'Élégance shall not be held liable for any booking error attributable to the client, in particular regarding the date, package or number of attendees.
ARTICLE 3 – PRICES AND PAYMENT
The applicable prices are those indicated at the time of booking.
Prices are stated inclusive of all taxes (VAT included), unless otherwise specified.
Payment may be made using the payment methods available at the time of booking.
An order is only definitively confirmed once payment has been accepted, or in accordance with the specific conditions agreed upon with Cabaret L'Élégance.
ARTICLE 4 – NO RIGHT OF WITHDRAWAL
In accordance with Article L.221-28, 12° of the French Consumer Code, the fourteen-day right of withdrawal applicable to certain contracts concluded at a distance cannot be exercised in particular for catering or leisure activity services to be provided on a specific date or during a specific period.
Accordingly, any booking made for a performance on a specific date is firm and final upon confirmation.
The client therefore has no right of withdrawal following the purchase of a ticket or the confirmation of a booking.
ARTICLE 5 – NON-REFUNDABLE TICKETS
Purchased tickets and confirmed bookings are neither cancellable nor refundable at the client's request, including in the event of absence, illness, personal circumstances, an error in the booking date or any other personal reason, subject to applicable mandatory legal provisions.
Failure by the client to attend on the scheduled date does not entitle them to any refund or credit.
However, as a gesture of goodwill, Cabaret L'Élégance offers clients the option of requesting a date change under the conditions set out in the following article.
ARTICLE 6 – DATE CHANGES AT THE CLIENT'S REQUEST
Subject to availability for the newly chosen performance, Cabaret L'Élégance accepts date change requests under the following conditions:
Request made at least 72 hours before the performance date:
The date change is accepted free of charge.
Request made less than 72 hours before the performance date:
A date change remains possible, subject to availability, upon payment of €25 VAT incl. in amendment fees per ticket rescheduled.
Once the performance has begun or in the event of non-attendance, no rescheduling, refund or credit will be granted.
All date change requests must be submitted to Cabaret L'Élégance by phone, e-mail or any other contact method officially provided by the venue.
A date change is only final once confirmed by Cabaret L'Élégance and, where applicable, once the corresponding fees have been settled.
In the event of a price difference between the original booking and the newly chosen date or package, the client will be required to pay any applicable supplement.
ARTICLE 7 – MEALS, MENUS AND MODIFICATIONS
For packages that include a meal, the menu served corresponds to the reserved package.
Any request to modify the menu or any specific dietary requirement must be communicated to Cabaret L'Élégance at least 72 hours before the performance date.
Any menu modification requested less than 72 hours before the performance date or directly on-site will be charged at €10 VAT incl. per person concerned.
Such modifications remain subject to the capabilities of the kitchen and the availability of ingredients. Payment of the €10 fee therefore does not guarantee that the requested modification can be fulfilled.
Cabaret L'Élégance cannot guarantee that a last-minute modification will be possible, particularly in the event of technical constraints, unavailability of ingredients or operational limitations.
ARTICLE 8 – ALLERGIES AND DIETARY INTOLERANCES
The client is responsible for communicating any food allergy or dietary intolerance affecting any person included in their booking.
Any food allergy or dietary intolerance must be reported without fail at least 72 hours before the performance date.
Any request communicated less than 72 hours before the performance will be considered a late request. Cabaret L'Élégance will make every reasonable effort to offer a suitable alternative where technically feasible, without being able to guarantee that a menu adaptation can be provided.
Cabaret L'Élégance cannot guarantee the complete absence of traces or cross-contamination.
In the event of a severe allergy, the client is strongly encouraged to contact the venue directly before making a booking, in order to verify whether the service can be provided under appropriate conditions.
ARTICLE 9 – TIMINGS AND LATE ARRIVALS
The client undertakes to adhere to the timings indicated on their ticket or booking confirmation.
For dinner-show packages, a late arrival may disrupt or prevent part or all of the meal service.
In the event of significant delay, Cabaret L'Élégance cannot guarantee the full delivery of all services included in the reserved package.
No refund or price reduction may be claimed when the inability to provide part or all of the service is the result of the client's late arrival.
Access to the venue during the performance may be delayed until an appropriate moment so as not to disrupt the show.
ARTICLE 10 – SEATING ARRANGEMENTS
Seating is arranged by Cabaret L'Élégance according to the reserved package, seating categories, the venue's configuration, the number of guests per booking and operational requirements.
Where a package specifies a particular zone or category, Cabaret L'Élégance undertakes to honour that category, subject to safety requirements or exceptional operational constraints.
Unless a specific numbered seat has been sold, the reservation of a package or category does not guarantee a specific table or seat.
ARTICLE 11 – PROGRAMME CHANGES
Due to the nature of live performance, the artistic cast, the order of acts, certain performers, costumes, sets or programme elements may be subject to change without such minor adjustments necessarily constituting a material modification to the service sold.
Cabaret L'Élégance reserves the right to adapt the programme for artistic, technical or safety reasons.
Such adaptations do not entitle the client to a refund, provided they do not substantially alter the nature of the service purchased.
ARTICLE 12 – CANCELLATION OR RESCHEDULING BY THE CABARET
In the event of a performance being cancelled by Cabaret L'Élégance, affected clients will be notified as promptly as possible.
Depending on the circumstances and applicable legal provisions, they may be offered:
- rescheduling of their booking to another date;
- a credit note;
- or a refund of the cancelled service.
In the event of rescheduling decided by Cabaret L'Élégance, the applicable terms will be communicated to the affected clients.
The provisions of this article do not affect the rights available to consumers under applicable mandatory legal provisions.
ARTICLE 13 – FORCE MAJEURE
Cabaret L'Élégance shall not be held liable for failure to fulfil its obligations where such failure results from an event meeting the conditions of force majeure within the meaning of Article 1218 of the French Civil Code.
In the event of a temporary or permanent impediment resulting from a force majeure event, the consequences for the booking will be determined in accordance with applicable legal provisions.
ARTICLE 14 – CONDUCT AND SAFETY
ARTICLE 14 – CONDUCT, DRESS CODE AND SAFETY
Cabaret L'Élégance is a live performance and dining venue. Smart, appropriate attire in keeping with the establishment's standards is required.
Cabaret L'Élégance reserves the right to refuse entry to the venue, in particular to any person:
who is visibly intoxicated;
whose behaviour is abnormal, aggressive, violent, abusive, threatening or likely to disrupt the smooth running of the evening;
whose conduct is likely to jeopardise the safety, peace or comfort of other guests, staff or performers;
who presents themselves in attire that is manifestly inappropriate to the standing of the venue;
who refuses to comply with safety instructions or the directions of staff.
These rules also apply throughout the entire duration of the client's presence at the venue. Cabaret L'Élégance may therefore ask any person who fails to comply with these conditions to leave the premises immediately.
Where refusal of entry or exclusion is the result of the client's conduct, visible intoxication, manifestly inappropriate attire or failure to comply with these rules, no refund, credit or date change will be granted.
All refusals of entry are applied in accordance with applicable legal provisions and may not be based on any ground of discrimination prohibited by law.
ARTICLE 15 – PHOTOGRAPHS, VIDEOS, RECORDINGS AND PROTECTION OF THE SHOW
It is strictly forbidden to photograph, film or record, in any manner whatsoever, all or any part of the show.
This prohibition applies in particular to images, videos, music, songs, soundtracks, voices, dialogue and performers' acts, and extends to any device capable of capturing or recording content, including mobile phones, cameras, camcorders, voice recorders and any other audio or video recording device.
In particular, it is strictly forbidden to record the music or songs featured in the show, whether in full or in part.
Any reproduction, copying, extraction, distribution, publication, uploading, sharing, transmission or exploitation, including on social media, video or audio platforms, websites or any other medium, is prohibited without the prior authorisation of the relevant rights holders.
These provisions apply in accordance with, in particular, Articles L.122-4 and L.212-3 of the French Intellectual Property Code, relating respectively to authors' rights and performers' rights.
Any reproduction, public performance or distribution carried out in violation of the rights protected under the French Intellectual Property Code may constitute an act of infringement and give rise to the civil and criminal penalties provided for in particular under Articles L.335-2 et seq. of the French Intellectual Property Code.
Failure to comply with this prohibition may result in the immediate cessation of the recording or capture and, in the event of refusal or repeat offence, immediate exclusion from the venue without refund, credit or date change.
In the event of any unauthorised capture, reproduction, distribution or exploitation of the show, its music or the performers' acts, Cabaret L'Élégance reserves the right to take any action necessary to protect its rights and those of the authors, composers and performers concerned, including filing a complaint and pursuing any appropriate legal proceedings.
ARTICLE 16 – GIFT VOUCHERS
Gift vouchers are valid for the duration specified and subject to the conditions indicated at the time of purchase.
The beneficiary must make a prior booking, subject to availability for the desired date.
Holding a gift voucher therefore does not guarantee availability for any particular performance.
Once a gift voucher has been used to book a specific date, the modification and cancellation conditions set out in these GTC apply to that booking.
ARTICLE 17 – CLIENT RESPONSIBILITY
A client making a booking on behalf of several people is responsible for communicating these terms and all relevant information to the other members of their group.
This includes, in particular, conveying the timings, access conditions and information relating to menus, allergies and dietary intolerances.
ARTICLE 18 – PERSONAL DATA
Personal data collected during the booking process is used to manage the order, payment, reservation and client relationship.
The processing of this data is carried out in accordance with applicable personal data protection regulations, including the General Data Protection Regulation (GDPR).
Clients may exercise their rights in accordance with the privacy policy published on the Cabaret L'Élégance website.

ARTICLE 20 – CONSUMER MEDIATION
In accordance with Articles L.211-3 and L.616-1 of the French Consumer Code, consumers may have free recourse to a consumer mediator for the purpose of reaching an amicable resolution to any dispute with Cabaret L'Élégance, provided that a written complaint has first been submitted to the venue and no amicable solution has been reached.
ARTICLE 21 – APPLICABLE LAW AND DISPUTES
These General Terms and Conditions of Sale are governed by French law.
In the event of a dispute, the parties will seek first and foremost to reach an amicable resolution.
In the absence of an amicable agreement or successful mediation, the dispute will be referred to the competent courts in accordance with applicable legal rules.
ARTICLE 22 – ACCEPTANCE OF THE GENERAL TERMS AND CONDITIONS OF SALE
When booking online, the client acknowledges having read these General Terms and Conditions of Sale prior to confirming their order and accepts them without reservation.
Confirmation of the order constitutes acceptance of these GTC.
ARTICLE 23 – PHOTOGRAPHIC AND AUDIOVISUAL RECORDINGS – RIGHT OF PUBLICITY
In the course of its activities, Cabaret L'Élégance may take photographs and make video recordings during performances, evenings and events held at the venue.
Such images may be used in particular for the communication and promotion of Cabaret L'Élégance, including on its website, social media channels, advertising materials, brochures and any other communication medium.
Clients who do not wish to appear in photographs or videos taken by Cabaret L'Élégance are invited to notify a member of staff upon arrival, before the start of the performance.
Cabaret L'Élégance will take all reasonably necessary steps to honour their request, in particular by refraining from photographing or filming them in an identifiable manner, or by blurring their image where necessary.
General footage of the venue, the audience and the atmosphere of the evenings may be captured in compliance with applicable regulations.
Any promotional use of photographs or videos featuring a clearly identifiable individual in a personal capacity will be subject to their prior consent where this is legally required.
In accordance with Article 9 of the French Civil Code relating to the right to privacy, and the General Data Protection Regulation (GDPR), in particular its Articles 6, 13 and 21, the persons concerned benefit from the rights applicable to the use of their image and the processing of their personal data.
Any person wishing to exercise their rights or request the removal of a photograph or video in which they appear may submit their request to:
Cabaret L'Élégance
E-mail: contact@cabaret-elegance.fr
Cabaret L'Élégance will consider each request in accordance with applicable regulations.
